Welcome to the course!
Throughout our journey together, you will gain an in-depth understanding of the legal issues surrounding the protection of cultural goods and cultural heritage, both in times of peace and armed conflict. We will cover regimes related to the transnational (licit and illicit) circulation of such goods.
You will learn to navigate the complex legal principles and rules involved in assessing various international and transnational questions, particularly where Europe is either the origin or destination of these goods. By the end of this course, you will be equipped to think about legal advice and seek adequate cooperation with authorities, with a clear understanding of potential outcomes in individual cases.
Special topics will include: a) Art, Cultural Heritage, and the Market: Ethical and Legal Issues b) Forgery in the Art Sector: Legal Context and Consequences c) Restitution and Repatriation in the Framework of Decolonization d) The Responsibilities of Museums, Collectors, and Heritage Professionals regarding Stolen/Looted Cultural Goods: Due Diligence Issues and Ethical Dilemmas e) Access to, Participatory Processes, and the Role of Civil Society in the Safeguarding and Valorization of Cultural Heritage f) Cultural Heritage, Archaeology, and Digital Technologies
